GrafTech International Faces Class Action Lawsuit Alleging Securities Fraud

GrafTech International Ltd., a leading manufacturer of graphite electrodes, is currently facing a class action securities lawsuit filed by shareholders who claim to have suffered losses due to alleged securities fraud. The lawsuit covers the period between February 8, 2019, and August 3, 2023.

According to the complaint, the defendants are accused of making false statements and concealing crucial information. It is alleged that GrafTech’s manufacturing operations in Monterrey, Mexico, have been contaminating neighboring communities with harmful carcinogenic gases and particulate matter for decades. The company is also accused of failing to honor commitments made to improve the environmental performance of its Monterrey facility.

Over a 30-year period, GrafTech allegedly disregarded warnings about the environmental impact of its operations in Monterrey. The complaint further claims that the company was not in compliance with applicable environmental laws and regulations. Additionally, GrafTech is accused of inadequately addressing the environmental problems caused by its Monterrey facility.

The government of Apodaca sought intervention from the State of Nuevo León authorities to address the adverse environmental impacts caused by GrafTech’s operations. The complaint alleges that the company’s purported cost leadership was achieved by neglecting appropriate environmental safeguards at its Monterrey facility.

As a result of these alleged actions, GrafTech is said to have been exposed to undisclosed material risks, including potential government action or enforcement that could severely disrupt its manufacturing operations in Monterrey. The complaint also claims that the company’s supplies of pin stock and graphite electrodes could be withdrawn or materially diminished, thereby harming its business, operations, reputation, and financial results.
