M&S Wins Copying Claim Against Aldi, Aldi Considers Position

Aldi has lost its appeal against a court ruling that found the supermarket chain copied the design of Marks & Spencer’s Christmas gin bottles. The court ruled last year that Aldi had infringed on the design of M&S’s light-up gin bottles. Aldi argued that there were differences between the two products, but the court found “striking” similarities that would be significant to shoppers. The Court of Appeal has now dismissed Aldi’s appeal, with three judges unanimously upholding the initial ruling. Aldi is currently considering its position in response to the judgment. M&S welcomed the decision, stating that it takes intellectual property seriously and will always defend its rights against infringement.
